Terms and conditions of use

Preamble

Cadrazur, SAS with a capital of 60 000 euros, RCS 402876619 00105, whose address is Chemin des Delphiniums, 83140 Six-Fours-Les-Plages (Var, France).
Any order placed with Cadrazur implies the unreserved adhesion to the present general terms of sale, which cannot be derogated from in any case, except with an express and written agreement

THE ORDERS

Orders are accepted :

  • By mail on plain paper or order form pre-established by Label Art,
  • By telephone, by fax, by internet on our website https://www.label-art.com/en/

PAYMENT OF ORDERS

The payment of the orders is done in cash, using the various means mentioned below:

  • by bank check, postal check, money order for written orders, with the exception of products offered in flash sales, any flash sale must necessarily be paid by credit card directly via the website.
  • by credit card for orders placed by fax, telephone, paper or internet

CONTRIBUTION TO THE POSTAGE AND PACKING FOR SHIPMENTS IN METROPOLITAN FRANCE AND CORSICA

The participation to the postage and packing is applicable in Metropolitan France, except Corsica:

Small parcel delivery (your order does not include any bulky item): the rate is estimated according to the weight of the parcel. A free delivery charge of 6€90 is applied for any order exceeding 99€ (excluding Corsica). The "FLEXI +" option, at 1€45, allows you to follow the progress of your parcel by being informed by SMS of the upcoming delivery. Small packages are shipped by GLS. A tracking number is sent by email the day the order is shipped by our services, in order to follow the routing and delivery of the package.

Your order contains at least one bulky item: the delivery rate will depend on the weight of your package. Large packages are shipped by GEODIS. A tracking number is sent by email. The day after the shipment, GEODIS contacts the recipient by email to arrange a delivery date. The recipient has 7 days to make the appointment. If, despite the various reminders, the delivery appointment is not set within the time limit, the shipping and return costs of the package will be charged to the recipient (as well as the costs of a possible redelivery).

If you want your order to be shipped within 72 hours, a supplement of 10 € will be requested in addition to the charges.

Bulky items are considered as all those exceeding the size imposed by the GLS carrier or your orders not being monocolis. Ex: Canvas rolls, frames and stretchers exceeding 20 cm, easels, this list is not exhaustive.

SPECIFICITY OF THE ARTICLES PRESENTED ON THE LABEL-ART WEBSITE

The photos and color charts presented in our catalog are not contractual. They can not give rise to any dispute, question the order or engage in any way whatsoever our responsibility. There are no "standard" or "approved" standards for brushes and colors. The colors proposed in the compositions of boxes, sets, caskets and others may be subject to change to allow the collections to evolve. Printing techniques, however efficient they may be, may distort certain shades. Wood is a living material, its original color varies and influences its color and patina finish. Manual patinas are never strictly identical. We take great care to ensure the constant quality of the products we describe.
If however any error could have occurred, or a data-processing error noted (ex: tariffs with 0€ or negative, handing-over close to 100 % or higher than 100 %, this list not being exhaustive), we would not know how to in no case to be held for persons in charge. It appears obvious to the customer that this is a bug for which we could not be held responsible. The order will therefore be cancelled and Label Art will reimburse the delivery costs on the article if they have been borne by the customer. Label Art will undertake to repair the bug as quickly as possible and to inform its customer.

PRICES

All our prices are quoted in Euros and include the VAT in force at the date of publication. We reserve the right to modify them in case of a change in the VAT rate. These prices remain in force until the next edition of the price list. Cadrazur guarantees you the lowest prices by the logo "unbeatable price guaranteed". If, within 30 days after your purchase at Cadrazur, you notice a difference in price on an ordered article and appearing on your paid invoice, it is up to you to inform our sales department and to send us a proof of price (invoice, estimate). We will then systematically reimburse the difference noted for any article, sold under the same conditions, not benefiting from an exceptional discount or a promotion limited in time, nor a sliding scale discount, sold online on the Internet site only, by a company whose head office is located on French territory.

The operations associated with "promo codes" are only valid on the web. They are not cumulative with other current advantages. The promo code is to be filled in directly in the shopping cart tab. This code is applicable only once during the given period and no promo code can be applied on the same customer account (same name, same address or same credit card number) during its validity period.

THE "EXPRESS" SERVICE

The "Express" delivery service, billed at 10 euros, does not take into account weekends and public holidays. All orders placed before 12:00 noon by phone and paid by credit card are shipped within 72 hours, excluding weekends and holidays. Example: An "express" order placed on Friday before noon is shipped the following Tuesday, An "express" order placed on Friday after noon is shipped the following Wednesday. If one or several products are missing, Cadrazur proceeds to their refund(s), the rest of the order benefits from the normal "express" service. Cadrazur shall not be held responsible for any delay due to the delivery of the order by its carrier.

SHIPMENTS, RETENTION OF TITLE CLAUSES, CLAIMS

Upon receipt of the order, it is up to the client to note his reserves immediately upon receipt of the goods, by mentioning on the carrier's delivery note the defects or damages noticed, such as crushed, deformed, holed, stained packages .... this list is not exhaustive. The reserves mentioned and/or the possible damages to the goods, must be confirmed directly with the carrier, by registered letter with acknowledgement of receipt, within 48 hours following the reception, under penalty of foreclosure. Attention: the mention "subject to unpacking" is without value. The goods are considered as acquired by the buyer only after full payment of the invoice, the delivery not representing in any case a transfer of property: law n°80335 of May 12, 1980. Goods that do not conform to the order or are defective must be the subject of a written complaint within 48 hours of receipt. Upon receipt of the claim, Cadrazur will issue a file number. The defective or non-conforming goods must then be returned to Cadrazur within 15 clear days, without having been used and in the original packaging. Upon receipt of the returned goods, and subject to their real defects, Cadrazur will proceed, according to the availability of its stocks, to the replacement of the defective items or to their reimbursement. Cadrazur will pay the shipping costs. For this purpose, it is imperative to contact Cadrazur by e-mail, mail or telephone, so that a return file is opened. Cadrazur will then reimburse the return expenses, upon presentation of a receipt mentioning the exact amount of the expenses incurred. If the goods are not considered defective, the return costs to Cadrazur and the return of the goods shall be entirely and exclusively borne by the client. The customer shall be responsible for the eventual replacement of a coaster glass broken during transportation and shall present to Cadrazur the duly paid invoice for the replacement. Cadrazur shall then proceed to its reimbursement, within the limit of 10 euros including VAT per square meter replaced. No package sent by a customer with postage due is accepted by Cadrazur. No claim will be accepted after a 48 hours delay.

RETRACTION PERIOD

All articles can be the object of a right of retraction, by exchange or, refunding except for the frames, coasters of Art and bare or canvas frames out of standard, as well as the articles having been the subject of a personalization on request of the customer. A request must be made via the contact form on our website and an acknowledgement of receipt will be automatically sent.

The article to be returned must be intact, complete, packed.

The return or exchange request by the customer must be made within 14 days from the date of receipt or withdrawal of the package.

Article L121-20 of the Consumer Code

(Order nº 2001-741 of August 23, 2001 art. 5, art. 11 Journal Officiel of August 25, 2001)

The consumer has a period of 14 clear days to exercise his right of withdrawal without having to justify reasons or pay penalties, except, where appropriate, the cost of return.
The period referred to in the previous paragraph runs from receipt for goods or acceptance of the offer for services.


When the 14-day period expires on a Saturday, Sunday or holiday, it is extended to the next working day.

The refund will be made within a maximum of 14 days from the date of receipt of the goods (refund of the amount of the order + standard shipping costs).

The costs of returning the product following a withdrawal remain at the expense of the consumer.
